CRACKED.COM STICKER CONTEST
OFFICIAL RULES
Participation in the Cracked.com Sticker Contest (the “Contest”) constitutes your agreement to be bound by these Official Rules. NO PURCHASE NECESSARY TO ENTER OR WIN.
Sponsor: Cracked Entertainment, Inc., 1333 2nd Street, Santa Monica, CA 90401.
Eligibility: You must be a registered member of Cracked.com. Employees, officers and directors of Sponsor and their immediate family members are not eligible to participate in the Contest. Void where prohibited by law.
Entry: To enter, upload your sticker design through the forum thread on Cracked.com. There is no limit on the number of designs you may submit. The Cracked Editorial Staff reserves the right to create an article on Cracked.com that will feature our favorite Submissions. If we do so, by submitting a design, you agree to the use of your name in the article to appear on Cracked.com and for promotional purposes.
Contest Period: The Contest begins on Friday August 15th at 4 PM Pacific Time and ends on Friday August 22nd at 4 PM Pacific Time.
Selection of Winner: For the Submissions that we REALLY like, we will be awarding a prize. At least one winner will be selected, but we may select runners-up if there are other entries that we think are equally funny (in our humble opinion).
Prize: The creator of the winning sticker will receive a check for $50 and the glory of knowing that his or her design may be created and handed out to tens if not hundreds of loyal Cracked fans for their sticking pleasure. All runner-ups will receive $25. All federal, state and/or local taxes are the sole responsibility of the winner.
Notification: The winner will be notified by e-mail on or about Saturday August 23rd. If a prize notification or prize is returned as undeliverable and we are unable to reach the winner after at least 2 further attempts, the prize may be forfeited at the sole discretion of Sponsor.
Required Paperwork: As a condition to receiving the prize, the winner (and runner-ups) will be required to sign and return a separate assignment of rights in the design and, except where prohibited by law, a publicity release. Winner should allow approximately 3 weeks after mailing the paperwork to receive the prize.
Intellectual Property: You agree that Sponsor may use the Submission, or any portions or elements of the Submission, as described in these Official Rules without any payment or other obligation whatsoever to you. If you are selected as a Winner, you agree to assign and hereby do assign to Sponsor all of your rights, title and interest in the Submission. You represent and warrant that you are (a) the author/creator of the Submission, (b) that you are the present and sole owner of all right, title and interest in and to the Submission, (c) that it is an original work, (d) that you have the full, exclusive and unconditional right and authorization to submit the Submission, and (f) that no third party has any rights in or to the Submission. You agree to indemnify, defend and hold harmless Sponsor, and its subsidiaries, affiliates, successors and assigns, from and against any and all claims, demands, expenses, losses or liabilities including but not limited to reasonable attorney's fees and punitive damages that may be asserted against or incurred by them at any time in connection with the Submission, or any use thereof, including, without limitation, those arising from any breach, or alleged breach, of the warranties, representations and promises provided by you in these Official Rules. Sponsor reserves the right to modify designs in its sole discretion.
General Conditions: No purchase necessary. Sponsor is not responsible for and shall not be liable for: (i) misdirected or delayed mail or e-mail; (ii) telephone, telecommunications, hardware or third party software malfunctions, failures, or difficulties of any kind; (iii) any condition caused by events beyond Sponsor’s control that may cause the Contest to be disrupted, corrupted or terminated; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of participating in the Contest or foolish spending of the prize; or (iv) any printing or typographical errors in any materials associated with the Contest. Sponsor reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the systems required to conduct the Contest or operate the Sponsor web site, or who is otherwise in violation of these Official Rules. All issues concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participants, shall be determined by Sponsor in its sole discretion. All decisions of Sponsor are final. By participating in the Contest, you also agree to be bound by the Cracked.com Terms & Conditions and Privacy Policy.
Winners List: Winner(s) will be posted on Cracked.com. To obtain a written copy of the winners list, please send your request and a self-addressed stamped envelope to: Cracked Sticker Contest Winners List, 1333 2nd Street, Suite 100, Santa Monica, CA 90401, U.S.A. Requests must be received by September 7, 2008.
